General Damages – Injury Payments

Compensation paid in accident claims breaks down into two parts; compensation for injuries and compensation for financial losses.

The compensation paid for your injuries is referred to as ‘General Damages’. It is also known as “pain, suffering and loss of amenity” – loss of amenity being loss of enjoyment of life during the period of recovery.

The amount of General Damages awarded will depend on the extent of your injuries (both mental and physical), how long any symptoms will last and the impact they have had upon you and your life.

The level of damages will be based, in part, upon the medical report that we will arrange for you; the report will set out the injuries suffered, the impact they have had upon you and how long any remaining symptoms are likely to last.

Once we know what injury you have had and how long it will last, we will be able to advise you on how much we should be looking for by way of damages. We have access to thousands of decided cases that help us to value your claim and reference will also be made to the Judicial Studies Board Guidelines for the Payment of General Damages (the JSB guidelines). This is the reference guide for judges when they are looking to make awards. More importantly our many years of experience in dealing with claims like yours will help us get you the compensation you deserve.
