Sexual assault at work can take many forms; anything from inappropriate touching to rape falls within the category of sexual assault. Fortunately the sexist office culture that was prevalent in the 1970’s has long gone however there are still some who feel that ‘office banter’ and ‘just a bit of fun and a laugh’ is an excuse for groping and sexual harassment; it is not and such behaviour is not to be expected or tolerated in the workplace. If you have been a victim of such behaviour in the past three years you can look to claim for the stress and upset that it has caused you.

You can still be a victim if you were coerced into giving your consent, this can be the offer of promotion in return for sex or the refusal of promotion if you don’t comply. Basically if a position of power is abused then there may be a claim for compensation. It will need to be shown that there was some element of coercion and if both parties are of similar status within the organisation it will need to be shown than an element of force or intimidation was used.

Your employer is responsible for how your colleagues behave, act and conduct themselves during working hours and, in some circumstances, out of work hours but work related functions. This means that you may be able to bring your claim against your employer who will carry insurance for such claims meaning that it will be easier for you to obtain compensation.

If you have been the victim of any such assault or attack you can look to claim damages for:

Your injuries; both physical and mental injuries that you have suffered as a result of the assault.

Financial losses such as lost income if you need time from work for treatment or recovery as a result of the attack upon you.

Your claim can be dealt with on a No Win-No basis so you will not be charged a penny if your claim is unsuccessful.
