catching a sexually transmitted disease

If you have caught a sexually transmitted disease or infection from a person who, before you had sexual contact with them, did not tell you that they were carrying the disease or infection you may be able to claim compensation.

You can have two possible options for bringing a claim:

Damages can be claim made where the disease is contracted from:

  • a partner and you were not aware of your partners medical condition.
  • an incident of rape or sexual abuse.
  • a sexual assault carried out when you were unconscious through drink or drugs.

If you have contracted any form of disease or illness in these circumstances it is regarded as an assault and you may be able to claim compensation.

Payment can also be made for sexually transmitted diseases when there is a substantial recovery and also those diseases/illnesses that cause a permanent disability.

Examples of such diseases/illnesses include:

  • Chlamydia
  • Gonorrhoea
  • Syphilis
  • Genital Herpes
  • Non-specific Urethritis (NSU)
  • Trichomonas Vaginalis (TV)
  • Genital Warts
  • Pubic Lice
  • Scabies

This list is not exhaustive and other diseases/illnesses may also be covered.
