The CICA is a government funded organisation that makes payments to victims of violent crime and this includes rape and sexual assault. This can be rape or sexual assault to a female or male by:

  • a stranger
  • a member of your family or other relative
  • a family friend
  • a person in a position of trust or authority such as a teacher or doctor
  • anyone who forces you to have sex or sexual contact against your wishes and will.
For the purposes of bringing a claim to the CICA rape is classified as meaning sexual penetration by vagina, anus or mouth while sexual assault covers unwanted and uninvited touching of a sexual nature over or under clothing.
Compensation is paid to the victims of such assaults, in addition compensation is paid for:
  • unwanted pregnancy
  • transmission of sexually transmitted diseases
  • lost income if the attack left you unable to work either due to physical or mental damage
  • the cost of care
It is worth noting with regards to CICA claims:
  • The CICA make payments to victims of violent crime and this includes sexual assault and rape.
  • Rape includes abuse over a long-period of time by a family member and incest.
  • The CICA does not distinguish between male and female rape victims. The same opportunity to seek compensation is open to male victims of rape.
  • Claims, to the CICA, need to be lodged with the CICA within two years HOWEVER for matters regarding rape and sexual assault they will usually exercise their discretion to look at claims lodged outside of this limitation period.
  • It doesn’t matter if you were dating/married or related to your attacker at the time of the attack, you are still entitled to claim as much as if it were a total stranger.
  • It doesn’t matter if you were drunk or asleep, it is still a sexual offence and you are allowed to claim
