You may be worried about bringing your claim which is understandable as the chances are that you have not had too much contact with a solicitor before. However we appreciate that you may have questions about how your claim will be dealt with so we have set out below some of the more common questions that we are asked.

Will I have to go to court ?

Probably not as very few cases go to court and we have the knowledge and experience to settle your claim without the need to go to court. This does not mean that you won’t receive as much by way of compensation as if we had gone to court; it means we have proved you were the innocent party and we have established the extent of your losses.

If we do have to go to court we will keep you up to date at every stage and will arrange for you to be represented, usually by a barrister who specialises in your type of injury claim.

How long will my claim take ?

It is difficult to say as all cases are different. The amount of time it takes to conclude your claim will depend upon the extent of  your injuries and other losses, as well as the stance the other side takes; if they admit liability straight away then chances are the claim will settle quicker than if they deny responsibility.

How long do I have to make a claim ?

You have, in most cases, three years from the date of the accident to make your claim; this is known as the primary limitation period.  Different rules apply to children and those who lack the mental capacity to deal with their claim. Will I have to come to your office or travel for a medical appointment ?

No, we will use email and telephone as well as post to keep you up to date with your claim. At the outset we will arrange for an agent, from our nationwide network, to come and see you, at your convenience, to get all the required paperwork completed and signed so that your claim is can be up and running as quickly and efficiently as possible.

Likewise we will arrange for your medical examination (used to value your claim) to be carried out by a consultant near to your home, place of work or location of your choice wherever possible.

Will it cost me anything to bring my claim ?

Chances are we can deal with your No Win-No Fee agreement so that if your claim fails you don’t pay us a penny for the work we have done on your behalf. If you are successful then we limit your contribution towards our fees to a maximum of 25% of your damages.

Will I get into trouble at work for making a claim against my employer?

No, your employer is not allowed to sack you or in any way punish you for bringing a claim, your employer will usually have insurance and so any payment will come from them and not out of your employer’s pocket.

What is my claim worth?

The amount of compensation you will receive is influenced by your age, sex and the type of lifestyle you live. For example a 16 year old girl who rides horses and loses a leg will receive more money than a 70 year old housebound male with the same injury.
