By coming to this site you may well have been the victim of a dog bite and obviously you want to know what you can claim for and how much you can claim. Don’t be ashamed of that; claiming the most compensation we can for our Clients is what get us up in the mornig
You can claim for both the injuries and scarring you may sustain as well as any financial losses arising from the incident. In legalspeak these are known as ‘general damages’ and ‘special damages’ in that order.
There are many factors that can determine how much you can claim. The main thing is the extent of your injuries and how the attack affects you.
Your age and sex can be a strong determining factor; a scar on the leg of a 16 year old girl is always going to be worth more than the same scar on a 70 year old man. This isn’t to say that 70 year old men can not claim for cosmetic damage it is just that they won’t get as much.
When it comes to injuries there is no set tariff which is why it is important that you instruct a solicitor who knows what they are looking and what to look for. A good solicitor will obtain professional photographs of your scarring as well as reports that set out the extent of your injuries and whether any scarring is likely to be permanent and what, if any, treatment would be of benefit to you; the cost of any treatment will be recovered from the other side as part of your over all claim. If you are suffering psychological problems a report will be obtained setting out your problems and what treatment is needed; again the cost of this treatment will be included in your claim.
As well as the above I would also look to recover the following losses:
- Lost income – if you are off work as a result of the injury or the required treatment.
- Care and assistance – even if no money has changed hands you can claim for help, during your recovery, from family and friends.
- Property – the cost of any clothing or other property damaged in the attack will be included as ‘special damages’
- Treatment – as mentioned you can claim for any re-constructive/plastic surgery you may need as well as any counselling etc.
