Claiming for damage to my hair

If, as a result of neglect or lack of skill by your hairdresser or beautician, you have sustained injury or damage to your:

  • hair – this includes loss of hair or damage to the quality of your hair
  • head- this includes burns and cuts to you neck and ears
  • face – this includes burns and cuts
  • scalp – this includes itchiness, scabbing and infection

you can look to claim compensation and damages from the salon owners who must carry insurance to cover themselves for such an incident.

How long do I have to claim.

You have three years to make a claim from the date of the incident or the date that you realised there was a problem, the courts do have discretion to extend this period but only in exceptional circumstances. You are best starting your claim as soon as possible so as to preserve evidence and documents as well as obtain witness statements while facts are still fresh in people’s minds.

I was injured by a trainee at the salon – can I still claim?

It doesn’t matter whether you suffered injury at the hands of the senior stylist or a trainee on their first day; you were a paying customer and are entitled to receive quality service regardless of who carried out the procedure. The salon should ensure that all staff can carry out their tasks without inflicting injury or damage.

What can I claim for?

Here at Gartons we have access to specialist knowledge and experience in dealing with claim just like you and we will ensure that you receive all the compensation you deserve.

We will help you recover compensation not only for your injuries and the stress and upset caused by the damage but also:

  • the cost of any additional treatment that you may need to repair the damage done to your hair – you are not required to go back to the hairdresser that caused the problem in the first place.
  • lost income resulting from time off work for recovery or treatment as result of your injuries
  • all and any other financial losses resulting from the incident

My hairdresser has offered to fix the problem – do I have to let them ?

No, if you have already suffered injury or damage to your hair you may be wary of going back to the salon; you don’t have to. We would suggest that you go to another salon and ask them for advice and the cost of having, if possible, your hair repaired. For further advice get in touch with us today:
