Can I be sacked for making a claim against my employer?

Advice and assistance from Cohen Cramer Solicitors

If you claim for an injury caused by an accident at work you cannot be sacked by your employers.

It doesn’t matter if you have only been working there for a few weeks it is still unlawful to sack you if the primary reason for dismissing you is for bringing a personal injury claim. If you are dismissed for bringing a personal injury claim you can take your (former) employers to the employment tribunal and bring a claim for unfair or wrongful dismissal.

Another worry that may prevent you from bringing your claim is how paying you compensation may financially impact upon your employers. It  is important to understand that your employers are required to not only ensure that you are safe at work but also to have insurance cover for any claims made against them, and this includes claims made by employees such as you.

If you have suffered injury and loss as a result of an accident that was someone else’s fault then you are entitled to claim compensation, and we can help you.
