Sexual assault by Doctor/Health care provider.

If you feel that you have been sexually assaulted by your doctor or other member of the health profession that you can look to bring a claim for compensation for any stress or worry resulting from the assault.

A claim of this type can brought against the doctor’s practice or their local health authority if the assault occurred in the course of their employment such as an unnecessary and intimate examination. If you were to be sexually assaulted by a doctor in a nightclub you would not be able to bring a claim against their employers as they were not acting in the course of their employment. You could still bring a claim against them but it would be as an individual rather than an employee.

You do not need to suffer physical injury for it to be an assault; as mentioned it can take the form of an unnecessary and intimate examination or as has recently happened a doctor secretly taking photographs of legitimate examinations led to claims for compensation.

It may be the case that you don’t realise at the time that the assault has taken place as in the example given above or it may be that it takes many years for the incident to come to light.

Claims such as this are not straightforward and rather than given general advice we want to help you.
