HIV, Hep B/C testing kits recalled
A recent recall by the Medical and Health Products Regulatory Authority (MHRA) has raised concerns over test results for HIV, Hepatitis B and Hepatitis C given to patients.
These test kit devices used by the NHS throughout the UK have recently been flagged as potentially giving false results, leading to erroneous or missed diagnoses.
The full extent of the recall is currently unknown, but guidance issued by MHRA states that those who have been tested with the kit will be identified and advised to attend for a retest.
The device has been used in Genitourinary Medicine (GUM) clinics, sexual health clinics, general practitioners and carries the ‘Right Sign’ branding.
Those affected by the recall
This recall gives rise to the following possibilities:
- incorrect diagnoses of infection or blood born virus (BBV) leading to patients undergoing unnecessary treatment;
- failures to actually diagnose infection or BBV with patients missing out on essential treatment;
- patients free of infection or BBV needing to undergo the stress and worry of further testing.
Under the Consumer Protection Act 1987 those affected by the recall are entitled to make a claim for compensation. The appropriate amount of compensation will depend on which of the above categories claimants fall into.
There is no need to have been wrongly diagnosed to make a claim; it is possible to claim just for the stress and worry of having to go for a further test.
