Post-Traumatic Stress Disorder Claims 

If, as a result of a traumatic incident, you have developed Post-Traumatic Stress Disorder (PTSD) you may be entitled to make a claim for compensation.

PTSD can arise from an adverse reaction to a very stressful, frightening or distressing event, a prolonged traumatic experience including seeing or hearing actual death or have seen, heard or personally experienced threatened death, injury or sexual violation.

PTSD symptoms can include nightmares, flashbacks, sleep disturbance, avoidance behaviour, mood disorders, suicidal ideation or, hyper-arousal that affects breathing, pulse rate, and bowel and/or bladder control. Your Claim For PTSD

There does not have to be a physical injury to bring a claim for PTSD however it helps if it can be shown that you have been involved in an incident and with sufficient proximity to be able to be personally affected. For example, watching a news report about a serious road traffic on the television accident won’t allow you to bring a claim for PTSD whereas being involved in the incident would.

Types of events that can lead to PTSD include:

  • serious road accidents
  • violent personal assaults, such as sexual assault, mugging or robbery
  • a traumatic birth
  • prolonged sexual abuse, violence or severe neglect
  • witnessing violent deaths of a family member
  • being involved in military combat
  • being held hostage
  • terrorist attacks
  • a diagnosis of a life-threatening condition if the diagnosis was incorrect
  • an unexpected severe injury or death of a close family member or friend

If you have developed PTSD as a result of psychological trauma you may be entitled to compensation.

Claims for PTSD are not as straightforward as say, a whiplash claim. They require expert knowledge of the subject combined with the experience to recognise the symptoms and losses sustained due to the incident.

Claims can be brought against an individual’s or employer’s insurers if the incident occurred as a result of negligent actions. In addition, if the PTSD follows on from being the victim of a crime of violence you may be entitled to an award from the Criminal Injuries Compensation Authority.

What You Can Claim?

The level of compensation you can claim for PTSD depends upon the length of time and to the extent to which you are affected.  Severe cases can have permanent effects. Sufferers are prevented from working or from functioning at their pre-trauma level. All aspects of their life can be badly affected. Less severe cases will cause significant disability for the foreseeable future or will cause the sufferer problems for one to two years.

In addition to claiming for the mental injuries, we will, of course, claim compensation for any physical injuries you have sustained in the incident.

When to Bring Your Claim for PTSD

NOW. It may be necessary to obtain and preserve evidence in support of your claim so the sooner the better.

You have three years from the date of your reaction to bring your claim. This is known as the limitation period. If the person suffering reaction is under the age of 18, the three-year period starts to run on their 18th birthday but they can, of course, start their claim at any age.
